Re:    Procedures for Participation In Pearson Wetlands Mitigation Bank

Dear Sir/Madam:

    Thank you for your interest in the Ohio Wetlands Foundation's wetlands mitigation banking program.  We believe that this program stands to provide significant environmental benefits to the State of Ohio by pooling mitigation efforts in regions of the State to create valuable and viable wetland habitat.  This letter will provide you with a general explanation of the mitigation banking program.

    The role of the Ohio Wetlands Foundation (the "Ohio Wetlands") is limited to the identification, design and construction of suitable wetland and stream mitigation sites.   Our mission is to provide high quality compensatory mitigation for wetlands and stream impacts.  Compliance with all federal, state and local regulatory requirements rests solely with each entity proposing to impact regulated waters of the state.  These responsibilities include obtaining accurate delineation of wetland and stream areas, identifying and evaluating wetland and stream impacts and determining whether participation in the Ohio Wetlands mitigation banking program is practicable and acceptable to all relevant regulatory entities.  We strongly encourage you to discuss these issues fully with your own counsel, consultants and the Army Corp of Engineers and/or the Ohio EPA. 

    If you determine that participation in the Ohio Wetland's mitigation banking program is a viable option, please complete the enclosed Wetland Mitigation Banking Purchase Agreement and return four (4) signed copies, along with the appropriate fee and a copy of your ORAM, to the Ohio Wetlands Foundation to the attention of Vince Messerly at the address below.   We will return three (3) copies signed by Ohio Wetlands for your files, your consultant  and for submittal to the Army Corp of Engineers in connection with the permit processing.  Your check will be deposited into an escrow account pending the Corps' and/or Ohio EPA's approval of the proposed mitigation.  

    The cost per acre of wetland mitigation credit is currently set at $18,000.00.  Credits are sold in 0.1 acre increments therefore it is necessary to round up to the next whole 0.1 acre increment when computing acreage and associated costs. The compensatory mitigation ratio and corresponding acres of mitigation credit required is determined by the Army Corp of Engineers and/or the Ohio EPA.

   The Ohio Wetlands Foundation is very excited about its mitigation banking sites in Ohio. Mitigation efforts at our sites have resulted in restoration of significant and valuable wetland habitat. Please call me at (740) 654-4016 if you have any questions or concerns.
