Re: Procedures for Participation in Ohio Wetlands
Dear Sir/Madam:
Thank you for your interest in
the Ohio Wetlands Foundation wetlands mitigation banking program. We believe that this
program stands to provide significant environmental benefits to the State of
Ohio by pooling mitigation efforts in regions of the State to create valuable
and viable wetlands habitat. This letter will provide you with a general
explanation of the mitigation program.
The role of the Ohio Wetlands
Foundation (Ohio
Wetlands) is limited to the identification, design and construction of suitable
wetland mitigation sites. Our mission is to provide highest
quality off-site compensatory mitigation alternatives for unavoidable impacts to wetlands
throughout Ohio. Compliance with all federal,
state and local regulatory requirements rests solely with each entity proposing to impact
regulated wetland areas. These responsibilities include obtaining accurate
delineation of wetland areas, identifying and evaluating wetland impacts and determining
whether participation in the mitigation program of Ohio Wetlands is practicable and
acceptable to all relevant regulatory entities. We strongly encourage you to discuss
these issues fully with your own counsel, consultants the Army Corp of Engineers
and the Ohio EPA early the development process.
If you determine that participation in
our mitigation
program is a viable option, please complete the attached Wetland Mitigation
Purchase Agreement and return four (4) signed copies along with the appropriate fee and a copy
of the Ohio Rapid Assessment Method (ORAM) score to Ohio Wetlands at the address
below. Ohio Wetlands will return
three (3) copies of the fully executed agreement to you so that you can
distribute them to your consultant, the Army Corp of Engineers and Ohio
EPA in connection with the permit application process.
Your mitigation fees will be deposited in an escrow account pending the Corp
and/or Ohio EPA' approval of the
proposed wetlands impacts.
The cost for wetlands mitigation
at Slate Run is currently set at $16,000.00 per acre
of wetlands mitigation credit. The Ohio Wetlands Foundation may elect, at it's
discretion, to reduce mitigation cost for larger purchases.
The amount of compensatory mitigation required is determined
by the Army Corp of Engineers and/or the Ohio EPA. All purchases must be rounded
up to the next whole tenth (0.1) acre. Fore example, if your project will impact
0.57 acres of wetlands and the Corps requires you to mitigate at a 2:1 ratio,
your mitigation need will be 2 x 0.52 = 1.04 acres. Rounding up to the
next whole tenth acre, will require the purchase of 1.1 acres of wetlands
mitigation credit.
